1. Agreement to Terms
These Terms & Conditions ("Terms") form a binding agreement between you ("you," "your," or "Customer") and CAD Variables, LLC, a Delaware limited liability company doing business as "CAD Variables" ("CAD Variables," "we," "us," or "our"), governing your access to and use of the website at cadvariables.com and the related drawing-generation service (together, the "Service").
By creating an account, purchasing a drawing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of a company, you represent that you are authorized to bind that company, and "you" includes that company.
2. Definitions
- "Account" — the account you register to use the Service.
- "Drawing" — a generated PDF output of the Service, produced from the parameters and information you provide. This includes both (a) elevator-entrance filing drawings and (b) elevator cab interior rendering PDFs ("Renderings") produced by the cab configurator.
- "Content" — the project details, dimensions, materials, company information, files, and other data you enter or upload.
- "Plans" — the paid tiers described in Section 6 (currently a pay-per-drawing "Basic" tier and a subscription "Premium" tier).
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your password and for all activity under your Account. Notify us promptly at support@cadvariables.com of any unauthorized use. We may suspend or terminate Accounts that violate these Terms.
4. The Service
The Service currently offers two tools. The entrance configurator lets you configure an elevator-entrance specification (entrance type, frame, sill, dimensions, materials, and title-block details) and generates a corresponding filing-drawing PDF from a parametric model using those inputs. The cab configurator lets you design an elevator cab interior (panel layouts, rails, ceiling, lighting, flooring, entrance, and material finishes, including material photos you upload) in an interactive 3D view and generates a rendering PDF of that design together with its specification. The Service is a drafting- and visualization-automation tool. It produces Drawings from the information you supply and does not independently verify your inputs.
5. Drawings and Customer Responsibility
5.1 Generated from your inputs. Drawings are generated solely from the parameters and information you provide. You are responsible for the accuracy and completeness of those inputs and for reviewing each Drawing to confirm that it reflects the information you entered.
5.2 Suitability for your purpose. Drawings are provided for your filing, documentation, and review or approval purposes, and may be used for fabrication at your discretion. You are responsible for reviewing each Drawing and determining whether it is appropriate for your intended use.
5.3 Tool, not advice. The Service is a drafting-automation tool, and Drawings do not constitute professional advice. Your use of any Drawing is at your own discretion, subject to the limitations in Sections 12–14.
5.4 Renderings are visualizations. Cab Renderings are computer-generated visual representations intended for design review, customer presentation, and specification. On-screen and printed colors, materials, lighting, and reflections are approximations and may differ from physical samples and finished work. Renderings are not dimensioned fabrication drawings, and you are responsible for verifying materials and finishes against physical samples before ordering or fabricating.
6. Plans, Fees, and Billing
6.1 Pricing. Current pricing for each Plan and for individual Drawings is shown in the Service at the time of purchase. We may change pricing prospectively; changes do not affect Drawings already purchased or the current paid period of an active subscription.
6.2 Included drawings. New Accounts may receive a limited number of complimentary entrance filing drawings (an "included-drawing" allowance) as shown in the Service. The allowance applies to entrance filing drawings only — it does not apply to cab Renderings. The allowance is per Account, is non-transferable, has no cash value, and may be changed or withdrawn for future users at any time.
6.3 Pay-per-drawing. Entrance filing drawings and cab Renderings are each billed per generated PDF at the rate shown in the Service for your tier at the time of purchase (Premium members receive the lower member rate on both). You authorize the applicable fee when you request a Drawing. We may place a hold on your payment method and capture the charge when the Drawing is successfully generated. Failed generations are not charged.
6.4 Subscription (Premium). Premium is billed in advance on a recurring basis (e.g., monthly) at the rate shown at signup. Your subscription renews automatically at the end of each billing period until you cancel. You may cancel at any time through your Account or the customer portal; cancellation takes effect at the end of the then-current paid period, and you retain Premium access until then.
6.5 Saved payment methods. If you save a card, you authorize us (through our payment processor) to store it and to charge it for Drawings and subscription fees you incur, including on an unattended ("off-session") basis, until you remove it or close your Account.
6.6 Taxes. Fees are exclusive of taxes. You are responsible for any sales, use, VAT, or similar taxes, excluding taxes on our net income.
6.7 Payment processing. Payments are processed by third-party processors (e.g., Stripe). We do not store full card numbers. Your use of payment features is also subject to the processor's terms.
7. Refunds and Drawing Discrepancies
7.1 Discrepancy support. If you believe a Drawing contains an error relative to the inputs you provided, contact us at support@cadvariables.com (or via the in-app contact form) and attach the affected PDF. We will review it and, at our discretion, either correct the Drawing or issue a refund for that Drawing.
7.2 Scope. Refunds and corrections under this Section apply to defects in generating a Drawing from your inputs. They do not cover errors caused by incorrect, incomplete, or unsuitable inputs, changes to your project, or your failure to review a Drawing as described in Section 5.
7.3 Subscriptions. Except where required by law, subscription fees are non-refundable for partial periods. Section 7.1 still applies to individual Premium Drawings.
7.4 Method. Approved refunds are issued to the original payment method.
8. Intellectual Property
8.1 Our IP. The Service, including the website, software, parametric models, model library, templates, and all related intellectual property, is owned by CAD Variables or its licensors and is protected by law. Except for the rights expressly granted here, we reserve all rights. These Terms grant you no rights in our models or software other than the right to use the Service.
8.2 Your Content. You retain ownership of your Content, including material photos and finish samples you upload to the cab configurator. You grant us a limited, non-exclusive license to host, process, and use your Content as needed to operate and provide the Service (including generating, storing, and delivering your Drawings and, for Premium, maintaining drawing history and revisions). You represent that you have the necessary rights to any material images you upload.
8.3 Your Drawings. Subject to your payment of applicable fees and to Section 5, the finished Drawing output you generate is yours to use for your business purposes. This does not transfer to you any rights in our underlying models, templates, or software.
8.4 Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use them without obligation to you.
9. Acceptable Use
You agree not to: (a) use the Service unlawfully or for any unlawful output; (b) copy, resell, sublicense, or provide the Service to third parties as a service bureau except for delivering Drawings to your own clients in the ordinary course; (c) reverse engineer, decompile, scrape, or attempt to extract our models, source code, or templates; (d) circumvent usage limits, billing, or security; (e) upload malware or infringing, unlawful, or third-party-confidential material you have no right to submit; (f) misrepresent a Drawing as a sealed or certified engineering document; or (g) interfere with or disrupt the Service. We may investigate and take appropriate action, including suspension or termination, for suspected violations.
10. Third-Party Services
The Service relies on third-party providers (for example, cloud hosting, drawing-generation infrastructure, storage, email, and payments). Their availability and terms are outside our control, and we are not responsible for third-party services except as expressly stated.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to those practices.
12. Disclaimer of Warranties
THE SERVICE AND ALL DRAWINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING SECTION 5, WE DO NOT WARRANT THAT ANY DRAWING WILL BE ACCURATE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAD VARIABLES AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, OR FOR COSTS OF DELAY, REWORK, OR PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY DRAWING, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR A DRAWING WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SPECIFIC DRAWING GIVING RISE TO THE CLAIM, OR (B) THE TOTAL AMOUNTS YOU PAID US IN THE THIRTY (30) DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You will defend, indemnify, and hold harmless CAD Variables and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Content; (b) your use of or reliance on any Drawing, including without the review described in Section 5; (c) your violation of these Terms or any law; or (d) your infringement of any third-party right.
15. Term and Termination
These Terms apply while you use the Service. You may stop using the Service and delete your Account at any time. We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms or non-payment. On termination, your right to use the Service ends. Deleting your Account permanently removes your Account data and saved Drawings, and this cannot be undone; export anything you need first. Sections that by their nature should survive (including 5, 7, 8, 12, 13, 14, and 17) survive termination.
16. Changes to the Service and These Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; if we make material changes, we will update the "Last updated" date and, where appropriate, provide notice. Your continued use after changes take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Service.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction. [Optional — have counsel advise on including an arbitration clause and a class-action waiver.] Nothing in this Section prevents either party from seeking injunctive relief.
18. General
Entire agreement. These Terms and the documents referenced here are the entire agreement between you and us regarding the Service and supersede prior understandings. Severability. If any provision is unenforceable, the rest remains in effect. No waiver. Our failure to enforce a provision is not a waiver. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. Independent parties. The parties are independent contractors; these Terms create no partnership, agency, or employment relationship.
